Heather Gerken’s Op-Ed on Voting Rights

Heather Gerken, J. Skelly Wright professor at Yale Law and ISPS Faculty Fellow, writes an op-ed in the New York Times on the difficulty of amending the Constitution.

In “On Voting Rights, Amendments Are Too Hard to Achieve and Enforce” she argues that “amending the Constitution is a heavy lift,” even setting aside congressional gridlock and the issue of getting three quarters of the states to ratify.

“To win backing, it could be made too vague to be effective. If it included specific remedies, it might lose broad-based support.”
